Total Adventour (Riders Adventure LLC) is committed to providing you with an enjoyable and memorable experience and our top priority is your safety and welfare. Please read these terms and conditions carefully. By submitting an order to us and/ or purchasing and/or using our services, you agree to be bound by the following terms and conditions.
Bookings are accepted on the understanding that the client understands the possible risks inherent in adventure travel. Total Adventour (Riders Adventure LLC) reserves the right to amend the Terms and Conditions at any time, without notice. Any such amendments shall be effective immediately.
“Riders Adventure LLC” (hereinafter referred to as 'Company') and “You” (hereinafter referred to as ‘TOUR PARTICIPANT’, or ‘CLIENT’) accept these Terms and Conditions as a binding contract between Riders Adventure LLC and yourself.
1. Booking and Cancellation Policy
1.1. To secure your reservation, a deposit of $1000 must be paid at the time of booking. This amount will be deducted from the total cost of the tour. Remaining balance should be paid at least 60 days before the start of the trip. Payments need to be transferred by bank transfer. All bank charges for international transfers are to be paid fully by the Client.
1.2 Before starting the ride, $500 security deposit is required to cover eventual damages to the motorcycle or loss/damage of any other gear provided. This amount will be fully refunded after the tour. You can pay the security deposit when you arrive in Ulaanbaatar.
1.3 All payments shall be done in United States Dollar ($).
1.4 Once the tour has started, the Company shall make no return or refund to the Client, except as expressly described in this contract.
1.4.1 If the Client does not arrive on time to start the tour, the Company will not be liable for any refund and/or for a repeat tour.
1.4.2 If the Client does not arrive on time to start the tour, and requests to join after, an additional charge of $500 applies to deliver the Client to the touring group in the countryside.
1.5 Cancellation by the Client
1.5.1 In case of cancellation 30-60 days before the start of the tour, 50% of the tour price will be retained by the Company.
1.5.2 In case of cancellation less than 30 days before the start of the tour, full amount of the tour price will be retained by the Company.
1.5.3 Cancellations must be submitted in writing.
1.6 Cancellation by the Company
1.6.1 Our tours are subject to a minimum of four riders. Each tour will be reviewed one month before departure. If minimum rider count is not fulfilled, a full refund will be given to the registered riders. The Company will not be liable for compensation beyond a full refund of money paid.
2. Responsibilities of the client
2.1 The Client must accept the authority of the tour lead riders. The Company and tour lead riders will not be held responsible for incidents or accidents which may occur as a result of unwise personal initiative.
2.2 The Client acknowledges the inherent risks of the tour and will travel entirely at their own risk.
2.3 The Client is fully responsible for their own personal properties. The Company will not be responsible for any loss of personal properties.
2.4 The Client is responsible for obtaining the necessary visas and vaccinations.
2.5 The Client must comply with the laws and customs of Mongolia. If the Client does not respect the laws, or cannot provide necessary documents, or is delayed due to their own fault, the Client is responsible for the incurred costs.
2.6 The Client must have a valid passport and driving license.
2.7 If the Client fails to obtain a visa or not be able to board their plane to Mongolia or is not allowed to enter the country (Mongolia), the Company will not be liable for any refund.
2.8 The Client confirms that they are fit and able to complete the itinerary of the tour and has no health conditions that might put yourself or others at risk.
2.9 Anyone who is suffering from any illness or disability or undergoing a treatment for any physical or medical condition, must declare the nature of the condition to the Company formally. The Client must make their own arrangements for drugs and treatments required during the tour. If the Company is not informed this constitutes a breach of contract and may result in the Client being excluded from the tour. In this case, the Company is not liable for any refund.
2.10 The Mongolian government has a zero-tolerance law in relation to alcohol. DO NOT DRINK excessively the night before the start of the tour. Police in Ulaanbaatar are particularly vigilant and may seize the motorbike if the driver gives a positive alcohol reading.
2.11 The motorcycle allocated to the Client is their responsibility until it is returned at the end of the tour. The Client must not allow local people to sit on it or ride it.
2.12 The Company is entitled to charge the Client for any damage caused to the motorcycle. Any accidental damage to the motorcycle will be assessed and an estimate of repair cost provided. Spare parts will be genuine Yamaha parts, charged at retail rate.
2.13 The Client should not make any modifications to the motorcycle, except to adapt foot brake lever or raise handlebars. Factory original settings must not be tampered with.
2.14 If the Client rides away from the main track without the express permission of the tour lead rider, the Client is responsible for any damage to the motorcycle, including tire puncture, occurring at that time.
2.15 If any repairs or adjustments are required to the motorcycle during the tour, the Client must inform the tour lead rider as soon as possible.
3. Travel Insurance
3.1 The Client must have a full travel insurance and provide a copy of the travel insurance to the Company.
3.2 The travel insurance must cover cancellation, illness, and repatriation including emergency helicopter rescue and 24-hour emergency contact number with a human operator to authorize emergency rescue.
3.3 The Company is not responsible for any costs and expenses incurred in the event that the Client requires emergency rescue and evacuation within Mongolia or to destinations outside Mongolia.
3.4 The travel insurance must cover motorbike use and should not have any exclusion clause limiting protection for riding a motorcycle.
4. Alterations and Amendments
4.1 The Company reserves the right at any time to alter arrangements for any aspect of the tour. The Client will be informed of any changes prior to departure.
4.2 All information of the tour routes and distances are approximates and are shown as a guidance. If any unexpected events or circumstances which imply the security of the Client should occur such as defected roads, climatic conditions etc. the Company retain the right to alter the routes, dates, itinerary, or timetable as we see fit. The Client cannot claim any compensation in these circumstances.
4.3 The Company will not be held responsible for providing refund or compensations if a situation arises during the tour which necessitates a change in the itinerary (including threat of war, riots, civil action, strikes, political or legal restrictions, force majeure, or other situations beyond the Company’s control).
4.4 If for any reason beyond the control of the Company your return to Ulaanbaatar is delayed and causes a missed international departure, costs incurred must be borne by the Client. The Company will assist in providing necessary documents if proof is required from the insurance company for repayment of costs incurred.
4.5 If a Client or the entire group of riders decide to abort a tour for whatever reason and switch from the initial plan, additional transport charge of $300 per rider to return the bikes to Ulaanbaatar will apply.
5. Jurisdiction
5.1 Any dispute that may arise between the Client and the Company will be dealt with under Mongolian jurisdiction.
